At a court of law, if the judge figures out that there is ‘probable cause’ which means that a particular individual(s) has himself or herself committed the crime, then the warrant against the accused can be issued. It is the duty of the NYC  Police Department to arrest the individual(s) and detain them against the one for whom the warrant has been issued. The NYC Police Department officer can also arrest a person from the site of the alleged crime. For this, no previous arrest warrant is required.

Types of Warrants

Two types of warrants are resolved in the NYC – Arrest warrants and Bench warrants. Arrest warrants are issued depending on the sworn and signed ‘affidavits’, which highlight the ‘probable cause’.

Bench warrants are the ones which are issued by a court of law in cases where a person is held for disrespect to a order of a court. Bench warrants are mostly issued when a person does not report on time or does not show up on the date of a scheduled court hearing. These warrants give official permission to the law enforcement department to arrest the accused.
